Hefty fine for noisy neighbour (NCC press release)
A noise nuisance had his equipment seized and was given a £1916 fine this week after persistently ignoring warnings about the levels of noise coming from his property.
Lee Hobster, 33 of Beardsley Gardens in the Meadows was convicted at Nottingham Magistrates Court on 12 April after being found guilty of four breaches of a Noise Abatement Notice, issued to him on 13 January.
“We began monitoring Mr Hobster’s property in December 2009 after repeated letters from Environmental Health were ignored”; said Mr Richard Taylor from Environmental Health. “Mr Hobster was given a Noise Abatement Notice (a legal notice requiring the offender to stop causing noice nuisance with immediate effect) on 13 January and promptly went on to breach it four times within the space of two weeks.”
On 25 January 2010, Environmental Health were granted a warrant from the Nottingham Magistrates Court and council bailiffs seized a number of items of equipment from Hobster’s NCH property, including a portable television, a CD player, a tape player and various speakers.
Mr Hobster failed to attend court and was issued the fine in his absence. The court also issued a deprivation order for all the equipment seized from Mr Hobster’s property. This will not be returned
Lorraine Raynor, Head of Environmental Health said:
The complaints we receive about noise nuisance are taken seriously. Mr Hobster was given ample opportunity, but chose to ignore warnings. We are firmly on the side of Nottingham residents who want to enjoy their lives peacefully and will deal with the minority of people who choose not to respect this right. We try to deal with problems informally, but if this is not possible, we will take enforcement action against the offender, which can include prosecution and seizure of equipment such as televisions and stereo equipment.
